KwebbelTCG Terms of Service

These Terms of Service apply to the use of the KwebbelTCG online store and to all orders placed through this online store.

By placing an order, the customer confirms that they have had the opportunity to read these terms and agree to be bound by them.

KwebbelTCG operates exclusively as an online store. Collection, returns or visits at the registered address are not possible unless KwebbelTCG has expressly agreed to this in writing in advance.

2. Applicability

These terms apply to:

  • every visit to the online store;

  • every offer made by KwebbelTCG;

  • every order and agreement between KwebbelTCG and the customer;

  • pre-orders, regular products and temporary offers.

Mandatory statutory consumer rights always remain applicable. Where any provision of these terms conflicts with mandatory law, the statutory provision shall apply and the remaining provisions shall remain in force as far as possible.

3. Product Information

KwebbelTCG aims to describe products as fully, clearly and accurately as possible.

Product images are intended to represent the product being offered. Colours, packaging details, promotional stickers, manufacturer markings and minor production differences may vary slightly in reality.

For products available in different versions, languages, print runs or editions, the product description will state which version is being offered. The customer must check this information before placing an order.

Obvious writing, pricing, stock or display errors are not binding where it is reasonably clear that an error has occurred.

4. TCG Products and Random Contents

Booster packs, booster boxes, decks, tins, collection boxes and similar TCG products may contain randomly selected contents.

KwebbelTCG does not guarantee:

  • the presence of a specific card;

  • a specific rarity, pull rate or card value;

  • the quality of cards according to the standards of a grading company;

  • any specific future market or collectible value;

  • profit or an increase in value after purchase.

Disappointing contents, a low-value pull, a falling market price or a lower grading score do not in themselves mean that the product is defective.

The consumer’s statutory rights in the event of a genuinely defective, incorrectly delivered or non-conforming product remain fully protected.

5. Prices

All displayed consumer prices are in euros and include applicable taxes unless expressly stated otherwise.

Shipping costs and any other additional charges will be clearly displayed before the order is finally placed.

KwebbelTCG may change prices for future orders. A price change does not affect an order that has already been accepted, except where there is an obvious error and the order is therefore lawfully cancelled. Any payment already received will then be refunded in full.

6. Orders and Formation of the Agreement

The customer is responsible for correctly entering their name, delivery address, email address and other order details.

After placing an order, the customer will receive an electronic confirmation. KwebbelTCG may refuse or cancel an order where there is a valid reason, including where:

  • the product is found to be unavailable;

  • there is an obvious pricing or stock error;

  • payment cannot be confirmed;

  • there is a reasonable suspicion of fraud, misuse or unauthorised resale;

  • delivery to the specified address is not possible;

  • a supplier or manufacturer cancels an allocation or production run.

Where a paid order is cancelled, the amount received will be refunded as soon as possible through the original payment method.

7. Payment

The available payment methods will be displayed during checkout.

The customer must make full payment in accordance with the selected payment method. KwebbelTCG is not required to dispatch an order until payment has been successfully received or confirmed.

Payment providers may apply their own terms, security checks and processing times. KwebbelTCG does not necessarily receive all of the customer’s personal payment details.

8. Stock

Stock information is maintained as carefully as possible. However, a product may be ordered by several customers at the same time or the physical stock may differ from the registered stock.

Where an ordered product is found to be unavailable, KwebbelTCG will contact the customer. Depending on the circumstances, the customer may be given the option to:

  • wait for new stock;

  • choose an alternative;

  • cancel the relevant product;

  • cancel the entire order where delivery without that product would not be reasonable.

The amount paid for a cancelled product will be refunded.

9. Pre-orders

A pre-order is an order for a product that has not yet been officially released or has not yet been received by KwebbelTCG.

Release dates, delivery dates and allocations are determined by manufacturers, distributors and suppliers and are therefore estimates. These may be changed.

Where a pre-order is placed together with immediately available products, the entire order may be dispatched once all products are available. The customer may contact KwebbelTCG if separate shipping is preferred. Additional shipping costs may then apply.

Where a manufacturer or supplier reduces the available quantity, KwebbelTCG may be required to cancel a pre-order in full or in part. The customer will receive a full refund for the cancelled portion.

In the event of a significant delay, the customer will be informed as soon as possible. The customer may cancel a pre-order that has not yet been dispatched, unless the product was specially ordered according to personal specifications and a statutory exception applies.

10. Delivery

KwebbelTCG only delivers to countries and regions that are available during checkout.

The available shipping methods, shipping costs and any free-shipping thresholds are displayed during checkout and in the Shipping Policy.

Stated delivery times are estimates. KwebbelTCG will make reasonable efforts to process and dispatch orders on time but is not responsible for delays outside its reasonable control.

Where no specific delivery period has been agreed, the order will be delivered within the legally applicable period.

11. Delivery Address and Uncollected Parcels

The customer is responsible for providing a complete and correct delivery address.

Additional costs resulting from an incorrect or incomplete address may be charged to the customer where the customer is responsible.

Where a parcel is not collected, is refused or is returned by the carrier, KwebbelTCG will contact the customer.

Additional shipping costs may be charged for a new delivery. Where the order is cancelled, only costs that are legally permitted and actually incurred may be deducted.

12. Risk During Transport

For consumer sales, the risk of loss or damage generally remains with KwebbelTCG until the customer, or a third party designated by the customer, has physically received the product.

This may be different where the customer independently selects a carrier that was not offered by KwebbelTCG.

The customer is requested to report visible transport damage as soon as possible and to retain all packaging, shipping labels and damaged products. Late reporting does not automatically remove statutory rights, but it may make an investigation with the carrier more difficult.

13. Right of Withdrawal and Returns

Consumers normally have a statutory right of withdrawal of 14 calendar days for online purchases.

The conditions, return procedure, possible reduction in value, exceptions and model withdrawal form are described in KwebbelTCG’s separate Return and Refund Policy.

Opening a sealed TCG product does not automatically remove the statutory right of withdrawal. Where the handling of the product goes beyond what is necessary to assess it, a demonstrable reduction in value may be deducted.

14. Statutory Warranty and Conformity

New consumer goods are covered by the statutory warranty under applicable Belgian and European consumer law.

A product must comply with the agreement and with what the customer may reasonably expect based on the product description and its normal characteristics.

Where a product does not conform, the consumer may be entitled to free repair or replacement and, where this is not possible or reasonable, an appropriate price reduction or termination of the agreement.

Normal wear and tear, damage caused by misuse, improper storage, accidents, moisture, heat, sunlight, modification or actions of the customer do not constitute a defect for which KwebbelTCG is responsible.

For individual cards, minor printing and production differences do not automatically constitute a defect where they are normal for the relevant TCG product and clearly fall within customary production tolerances.

15. Complaints

Where possible, a complaint should include:

  • the customer’s name and contact details;

  • the order number;

  • a clear description of the complaint;

  • relevant photographs or other supporting evidence.

KwebbelTCG aims to respond to questions and complaints within a maximum of 10 days. Where further investigation is required, the customer will be informed.

The parties will first attempt to resolve any dispute through mutual consultation.

16. Use of the Online Store

The online store may not be used for:

  • fraud or deception;

  • placing false orders;

  • unauthorised access to systems or accounts;

  • distributing malware;

  • collecting personal data without a lawful basis;

  • infringement of intellectual property rights;

  • other unlawful or harmful activities.

KwebbelTCG may restrict access where there is a reasonable security or fraud-prevention reason.

17. Accounts

Where customers are able to create an account, they are responsible for keeping their login details confidential and for activities carried out through their account.

Suspected misuse or unauthorised access must be reported to KwebbelTCG as soon as possible.

KwebbelTCG may temporarily block an account where this is necessary for security, fraud prevention or legal compliance.

18. Intellectual Property

KwebbelTCG’s original texts, designs, logos, images and other content may not be copied, distributed or commercially used without permission.

Brand names, product names, characters, illustrations and logos belonging to Pokémon, One Piece, Magic: The Gathering and other rights holders remain the property of their respective owners.

Offering these products does not automatically mean that KwebbelTCG is officially affiliated with, endorsed by or sponsored by these rights holders.

19. External Services and Links

The online store may use third-party services, including Shopify, payment providers, carriers and social media platforms.

The use of such external services may be subject to the additional terms and privacy policies of the relevant third party.

To the extent permitted by law, KwebbelTCG is not responsible for the content or operation of external websites over which it has no control.

20. Liability

Nothing in these terms limits statutory consumer rights or liability that may not legally be excluded.

KwebbelTCG is responsible for damage directly resulting from an attributable failure to perform, in accordance with the rules of applicable law.

KwebbelTCG is not liable for damage resulting solely from:

  • incorrect or careless use by the customer;

  • improper storage or handling;

  • normal market-price fluctuations affecting collectible products;

  • disappointing random contents or pull rates;

  • information incorrectly entered by the customer;

  • events outside KwebbelTCG’s reasonable control.

This provision applies only to the extent permitted by law.

21. Force Majeure

KwebbelTCG is not liable for delays or failure to perform resulting from circumstances outside its reasonable control, including:

  • serious technical failures;

  • natural disasters;

  • strikes;

  • war or government measures;

  • transport problems;

  • fire;

  • epidemics;

  • failures involving suppliers, carriers or payment providers;

  • cancellation or delay by manufacturers or distributors.

KwebbelTCG will inform the customer as soon as possible and will attempt to provide a reasonable solution. Where performance becomes permanently impossible, the agreement may be terminated and the amount paid for the undelivered portion will be refunded.

22. Personal Data

KwebbelTCG processes personal data in accordance with its separate Privacy Policy.

Personal data is used, among other purposes, to fulfil orders, process payments, provide customer service, prevent fraud and comply with legal obligations.

23. Changes to These Terms

KwebbelTCG may amend these terms for future orders, for example due to changes in legislation, business operations or services.

An order is governed by the terms that were available at the time the order was placed, unless an amendment is legally required or is more favourable to the customer.

24. Applicable Law and Disputes

These terms and agreements with KwebbelTCG are governed by Belgian law.

This choice of law does not deprive a consumer of the protection provided by mandatory rules of the country in which the consumer normally resides, where those rules apply under applicable law.

Disputes will be handled by the competent court in accordance with statutory rules. This provision does not restrict the consumer’s right to use a competent authority or an alternative dispute-resolution procedure.
